Warranty terms and conditions for Shaper Origin (Gen2) of Shaper Tools GmbH
1. General terms and conditions
1.1 Shaper Tools GmbH, Dieselstraße 26, D-70771 Leinfelden-Echterdingen (hereinafter referred to as "Shaper") warrants to you as end user that Shaper Origin (Gen2) (hereinafter referred to as "tool") is free from defects in material and workmanship in accordance with these warranty conditions.
1.2 With these warranty conditions, Shaper grants you additional rights for your new tool, which exist in addition to your contractual and statutory claims for defects. The warranty conditions do not imply any waiver, restriction or other modification of the contractual or statutory rights in respect of defects.
1.3 Work or services provided within the warranty does not trigger an extension of the warranty period nor does it set in motion a new warranty period. The same applies to the limitation of contractual or statutory rights for defects.
2. Duration of warranty, registration
2.1 The warranty period starts on the date indicated on your original proof of purchase and lasts 12 months. You can extend the warranty period to a total of 24 months by registering the tool on shapertools.com/register within 30 days of the date of the original proof of purchase.
2.2 If you resell your tool, the warranty period does not recommence. Under the conditions of this warranty, however, the subsequent purchaser may assert warranty claims.
3. Eligibility and scope of the warranty
3.1 To be eligible for the warranty, the tool must be purchased on shapertools.com or from an authorised Shaper-dealer.
3.2 In the event of a warranty claim and during the warranty period, Shaper grants you a right to repair or replacement of the tool free of charge. There are no further warranty claims.
4. Territorial scope
The territorial scope of the warranty is limited to the Shaper Service Umbrella.
5. Warranty exclusions
The following are excluded from the warranty:
a. normal wear and tear;
b. damage to consumables and accessories (e.g. cutters, collets, etc.);
c. faults or defects that have arisen as a result of improper installation, commissioning or repair, inadequate maintenance or care or other improper use contrary to the recommendations and instructions in the operating instructions (e.g. use in a wet environment);
d. faults or defects caused by the installation or use of accessories or spare parts that are not original parts;
e. faults or defects resulting from continuous heavy wear and tear, especially in industrial continuous operation, or from continuous above-average use of the tool.
6. Assertion of warranty claims
Warranty claims must be made in writing to Shaper immediately after discovery of the defect and within the warranty period. When making a warranty claim, the defect or fault that has occurred must be described and the original proof of purchase, indicating the date of purchase and the product designation, must also be submitted.
7. Inspection and reporting obligations of commercial buyers
If you have purchased the tool as a commercial business, warranty claims are only eligible if you have inspected the tool immediately on receipt and have notified Shaper in writing of any visible defects immediately, at the latest within two weeks after receipt of the tool, and of any hidden defects immediately after their discovery.
You are a commercial business if you acted in the exercise of your commercial or independent professional activity when concluding the purchase contract. This applies to both natural persons and legal entities and partnerships with legal capacity.
8. Final provisions
8.1 The personal data that we receive when you register your tool for warranty (incl. invoice upload) (e.g. first and last name, email address) will be processed exclusively for handling associated services. The legal basis for this is Article 6 (1)(b) GDPR. Further information on data privacy can be found hier.
8.2 Shaper reserves the right to discontinue, amend or modify the work or services under warranty or these warranty conditions in whole or in part, subject to a reasonable period of notice, or, in the event of good cause, without such notice, with due regard to your interests.
8.3 The law of the Federal Republic of Germany shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
8.4 The exclusive place of jurisdiction for all disputes arising from the warranty is the registered office of Shaper.
8.5 Should any provision of these warranty conditions be or become invalid or unenforceable in whole or in part, or should there be a gap in this warranty, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid or enforceable provision that comes closest to the purpose of the invalid or unenforceable provision. In the event of a gap, the provision that corresponds to what would have been agreed in accordance with the purpose of this warranty shall be deemed to have been agreed.
